Public Hearing Wed September 14th after 7:30 P.M.

The Town of Greenburgh hopes  to add a local law to regulate the sale of, display, and advertising of tobacco, electronic cigarettes, and smoking paraphernalia. A public hearing is being held on September 14 at the Town Board meeting.

The main purpose of this  proposed code is to “implement effective measures mitigating the marketing and sale to youth” by ensuring these activities cannot happen within 1,500 feet of a school.

After defining the applicable terms from advertisement to vapor products, the main section of code reads as follows:

No person, corporation, partnership, sole proprietor, limited partnership, association or any other business entity may place, cause to be placed, maintain or cause to be maintained, smoking paraphernalia or tobacco product, electronic cigarette, or vapor product intended or reasonably expected to be used with or for the consumption of nicotine advertisements in a store front or exterior window or any door which is used for entry or egress by the public to the building or structure containing a place of business within one thousand five hundred (1,500) feet of a school.

Any entity or individual convicted of violating the above law would be fined up to $500, with each day of continuing violation constituting a separate offense. 

A second subsequent conviction for the same offense would be punishable by a fine of up to $1000, with each further day of violation a separate offense.

Since the last Town Board meeting, minor edits were made to the address the public’s concerns. The hearing continues this Wednesday night, Sept 14.  We have received additional suggestions from the Edgemont Community Council which will be reviewed and considered before any law is approved.
